GENERAL CONDITIONS

CANCELLATION OF THE CONTRACT BY THE CLIENT

In the event of cancellation, the following conditions will apply:
– If the cancellation occurs more than 15 days before the check-in date, 100% of the rental prepayment will be refunded.
– If the cancellation occurs 14 days or less before the check-in date, it will be penalized with 100% of the rental prepayment amount.
– In the event of a no-show (NO SHOW), the tourist will lose 100% of the rental amount.
No refunds will be granted if the client voluntarily discontinues the services before completing their stay.

MODIFICATIONS BY THE COMPANY

In the event that, due to unforeseen and non-imputable causes to the company, the accommodation cannot be occupied, the company will make available to the client another accommodation of equal or superior characteristics without reimbursement by either party.

DATA PROTECTION

In compliance with the provisions of the Organic Law 15/1999, of December 13, on the Protection of Personal Data (“LOPD”), we inform you that by completing the booking process, your personal data will be incorporated into the company’s files in order to provide and offer our services. Likewise, we inform you of the possibility to exercise your rights of access, rectification, cancellation, and opposition to your personal data, with the company being the file controller.

Data Collection

Your data is collected by the HOLDER.

Personal data refers to all information related to an identified or identifiable natural person (data subject). An identifiable person is one who can be identified, directly or indirectly, especially by reference to a name, an identification number (DNI, NIF, NIE, passport), or one or more specific elements specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.

The data that will generally be collected includes: Name and surname, address, email, phone number, date of birth, data related to payment methods. Other types of data may be collected, and the User will be informed.

Purpose of Processing Your Personal Data

The purpose of processing the personal data that may be collected is primarily for the HOLDER to manage its relationship with you, offer you products and services according to your interests, improve your user experience, and, if applicable, process your requests, petitions, or orders. A commercial profile will be created based on the information you provide. No automated decisions will be made based on this profile.

The provided data will be kept for the duration of the business relationship, as long as the interested party does not request its deletion, or for the years necessary to comply with legal obligations.

It will be recorded in the customer file, and its processing will be recorded in the register of treatments that the HOLDER must keep (before May 25, 2018, it could also be included in the file prepared with the personal data registered with the AEPD or the competent body of the respective Autonomous Community). The name of the file is as follows: Privacy Policy.

Legitimation for the Processing of Your Data

The legal basis for the processing of your personal data is:
– The correct execution or fulfillment of the contract
– The legitimate interest of the HOLDER

Recipients to Whom the Data Will Be Communicated

The User’s personal data may eventually be communicated to third parties related to the HOLDER by contract to perform the necessary tasks for the management of their customer account without the need for their authorization.

Also, if communications need to be made to authorities in the event that the User has taken actions contrary to the Law or violated the content of the legal notice.

User data may be communicated to other group companies, if any, for internal administrative purposes that may involve the processing of such data.

The User’s personal data may be transferred to a third country or an international organization, but the User must be informed when such a transfer is to take place, as well as the conditions and recipient.

When some data is mandatory to access specific functionalities of the website, the HOLDER will indicate this mandatory nature at the time of collecting the User’s data.

Cookies

While browsing this site, cookies from the HOLDER of the site in question and/or third-party companies may be deposited on your computer, tablet, or mobile phone. During the first navigation, an explanatory banner about the use of cookies will appear.

User Rights

The user is informed of the possibility of exercising their rights of access, rectification, cancellation, and opposition. Also, each person has the right to limit the processing regarding them, the right to delete the transfer

of personal data transmitted to the data controller, and the right to the portability of their data.

The user has the possibility to file a complaint with the AEPD (Spanish Data Protection Agency) or the competent body of the respective Autonomous Community if they have not obtained a satisfactory solution in the exercise of their rights by writing to them.

Unless the User objects by sending an email to info@urbanpatios.es, their data may be used, if applicable, to send commercial information from Urban Patios SL.

The provided data will be kept for the duration of the business relationship or for the years necessary to comply with legal obligations.

The User is responsible for ensuring that the information provided through this website is accurate, responding to the accuracy of all communicated data and keeping it updated to reflect a real situation, being responsible for false or inaccurate information provided and the damages, inconveniences, and problems that it could cause to Urban Patios SL or third parties.

This information will be kept and managed with due confidentiality, applying the necessary computer security measures to prevent unauthorized access or use of your data, its manipulation, deterioration, or loss.

However, the User must bear in mind that the security of computer systems is never absolute. When personal data is provided online, such information may be collected without their consent and processed by unauthorized third parties.

Urban Patios SL declines any responsibility for the consequences of such acts that may have for the User if they voluntarily published the information.

You can access and exercise these rights by a written and signed request that can be sent to the address Calle Capilla del Monte 31, 21400 Ayamonte, Huelva, Spain, attaching a photocopy of the ID or equivalent document.

These rights will be addressed within 1 month, which may be extended to 2 months if the complexity of the request or the number of requests received so requires. All this without prejudice to the obligation to keep certain data in legal terms and until the possible responsibilities derived from possible treatment or, where appropriate, a contractual relationship have prescribed.

In addition to the above, and in relation to data protection regulations, users who request it have the possibility to organize the destination of their data after their death.
